Requirements
Invest personal funds of $800,000 in Targeted Employment Areas (TEA), such as rural or high-unemployment areas and certain infrastructure projects, or $1,050,000 in non-TEA areas.
Create or preserve at least 10 full-time jobs for qualifying U.S. workers.
Provide detailed documentation verifying the lawful source and transfer path of the investment funds.
Maintain the investment for a minimum of two years.
The U.S. position must require specialized knowledge (expertise that is distinct, advanced, and critical to the employer's operations).
The U.S. sponsor must belong to a multinational group with a corporate presence in the U.S. and at least one other country.
You must have been employed abroad as a manager, executive, or specialized knowledge worker by an entity of the multinational group for at least one year within the three years immediately preceding the visa application.
Pros
The only visa category that provides immigration status based on passive investment.
Does not require employer sponsorship, offering significant flexibility.
No specific educational or professional qualifications are required.
Allows for investment directly into new or existing businesses or through regional centers that pool funds for larger projects.
The only employment-based category allowing concurrent Green Card application filing for all nationalities.
Enables international companies to transfer key employees with technical or proprietary knowledge that is hard to find in the U.S.
Facilitates a smooth transition to permanent residency.
Focuses on the employee's role within the company rather than their overall career accomplishments.
Cons
Requires a substantial financial investment.
The investment must be at risk, and job creation requirements must be met.
Initially issued a two-year conditional Green Card, requiring a subsequent application to demonstrate continued compliance with the program requirements.
Offers fewer green card pathways compared to the L-1A.
Requires at least 1 year of prior employment within the same corporate group, making it unsuitable for new hires.
Maximum renewals are capped at 5 years.
